SHORT TERM VACATION AGREEMENT
Beach House Rental Terms and Conditions

This contract is between the Property Owner and the individual whose Name is on the Reservation Form. This individual must accept the terms & policies on behalf of all persons named on the Reservation Form. Only those individuals named and approved by the Property Owner are entitled to use of the premises.
Casa Mia considers check-in to commence at 2-6 p.m. and check-out at 10:45 a.m.
All Rent, Fees and Charges are payable to:

1. TO SECURE YOUR RESERVATION: The Reservation Deposit and “Short Term Lease”, signed by the Rental Guest, must be received within 48 hours of making a reservation, if not received within this time period this Reservation will be deemed to have been cancelled by the Rental Guest.

1A. RESERVATION DEPOSIT: A deposit of 50% is required at the time of booking. Once the reservation is confirmed, the deposit becomes non refundable and will be deducted from the remaining balance due.
1B. METHOD OF PAYMENT – We gladly accept checks for the payment if we have at least 30 days to process the check. Accepted forms of payment are in US funds only. For reservations made less than 30 days prior to arrival date, payment in full is required by Wire Transfer or Credit Cards: Visa or Master Card Accepted. Remember that your final payment is due 60 days prior to arrival.
INTERNATIONAL GUESTS: PAYMENT IS BY WIRE TRANSFERS ONLY PLEASE.

A 3.75% merchant transaction fee shall apply to all credit transactions.

2. PROPERTY DAMAGE INSURANCE REQUIRED $60.00
Casa Mia Beach House provides a no cost to Tenant the No Worries Protection Program against accidental damage reported before check-out, AND REQUIRES NO SECURITY DEPOSIT however we do require a credit card on file for incidental charges.
3. 7.SPA TERMS, POLICIES AND OPERATION DETAILS
Any individual using or operating the spa must be one of the registered guests.
Use of spa is solely at your own risk.
Any individual using the spa must be over the age of 21 or accompanied by a responsible adult.
Maximum capacity in the spa is four (4) people.
Please do not sit or stand on the top of the spa cover.
PLEASE ENJOY THE ADJACENT OUTDOOR HEATED SHOWER BEFORE ENTERING SPA to ensure sand, suntan lotions and oils are removed before entering the spa.
After exiting the spa PLEASE place a small capful of chemicals into the spa after each use and close the top. This ensures your spa remains sanitary and sparkling clean for your stay.
Excessive sand removal incurs a $45 service charge.
The rental guest signing below agrees to communicate policies of this agreement to all the guests identified in the reservation form.
The undersigned rental guest/tenant hereby releases, agrees to indemnify and hold harmless the property owner, his agents and officers from any and all liability, claims, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the undersigned or any person (including) Tenant’s guests), as a result of any cause arising out of the use and operation of the spa. This release shall be binding upon the distributes, heirs, next of kin, executors, administrators and personal representatives of the undersigned or any person (including Tenant’s guests).

♥ DO NOT use White Towels/Face Cloths to clean the floors, counters and sinks,
♥ DO NOT REMOVE MAKEUP using white towels or face cloths which causes PERMANENT DAMAGE,
♥ DO NOT WASH White Towels or Sheets with colored beach towels or your clothing.
♥♥♥TOWELS AND SHEETS ARE NOT REQUIRED TO BE MACHINE WASHED BY RENTAL GUEST.

••Missing Monogrammed Bathrobes incur a $150.00 replacement fee per robe.
••Missing Towels incur a replacement fee of $25.00 per towel, hand towels $15 & face cloths $10.
I agree that my liability for the charges is not waived and agree to be held personally liable in the event that the amount of such charges is not paid. I agree to be liable for all charges for any items removed from the house at the current rates established by the Property/Owner and for Excessive Cleaning (Excessive Cleaning) is defined as any required cleaning over 3 hours. Excessive Cleaning $45.00 per hour.
4. Personal Property:
All personal property of the tenant(s) on the said premises shall be and remain his sole responsibility and risk, and the owner shall not be liable for damages to, or loss of such personal property arising from any acts of negligence of any other persons nor from the leaking of the roof, or from bursting, leaking or overflowing of water or sewer pipes, or from heating or plumbing fixtures, or from the handling of electrical wires or fixtures, or from any cause whatsoever, nor shall the owner be liable for any injury to the person of the tenant(s) or other persons in or about the premises, the tenant(s) expressly agreeing to save the owner harmless in all such causes and events.
5.Indemnification/Right of Entry/Assignment
The undersigned Tenant hereby releases, agrees to indemnify and hold harmless the property owner, his agents and officers from any and all liability, claims, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the undersigned or any person (including Tenants guests), as a result of any cause arising out of the use of the house. This release shall be binding upon the distributes, heirs, next of kin, executors, administrators and personal representatives of the undersigned or any person (including Tenant’s guests). Tenant agrees that the owner or their respective representatives may enter the Premises during reasonable business hours to make necessary repairs. Tenant shall not assign this Agreement or sublet the Premises in whole or part without written permission of the owner.
*Occupancy (i.e., number of tenants staying overnight) is strictly restricted to the number of tenants that are reserved for (maximum of 4). At no time can there be more than a total of 4 people in the house (total of number of tenants reserved for plus visitors not staying overnight).
* Tenants will be in default of the Vacation Rental Agreement, Short Term Lease, if they have more tenants in the house than the number they have reserved for or if there are more than 4 people in the house at any time.
*No Pets Permitted
*VIOLATIONS of any occupancy conditions will be grounds for immediate eviction without refund of rent.
7. EXPEDITED EVICTION. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedure set forth in the Short Term Lease will apply. Tenant may be evicted under such procedures if Tenant: (i) Holds over possession after Tenant’s tenancy has expired; (ii) Commits a material breach of any provision of this Agreement that according to its terms would result in the termination of Tenant’s tenancy; (iii) fails to pay rent as required by this Agreement; or (iv) has obtained possession of the Premises by fraud or misrepresentation.
8. Casa Mia Rules:
As our guests we request that all furniture remain in the areas they have been placed. Hardwood and stone floors can be scratched easily if furniture is not moved with care.
Please clean up spills, remove trash twice a week (Sunday & Wednesday Nights) for curbside pickup.
*BATH TOWELS AND LINENS ARE NOT PERMITTED OUTSIDE THE VILLA.
*BEACH TOWELS ARE PERMITTED OUTSIDE THE VILLA.
9. NO SMOKING POLICY:
Casa Mia Beach House is a 100% smoke free environment. SMOKING IS PROHIBITED INSIDE AND OUTSIDE THE BEACH HOUSE PROPERTY. I agree to be liable for cleaning charges resulting from smoking. If there is any evidence of smoking, including but not limited to the smell of smoke, ashes in the house, burnt cigars or cigarettes in the house, or burn holes on the furniture or linens, the MINIMUM CHARGE will be a $500.00 recovery fee which will be charged to your Credit Card on file.
10. Late Check-In (After 6 p.m.): (KEY) will be in LOCK BOX on the exterior wall next to the mail boxes. In the event that the Guest has not vacated the property on the date of departure, at the due time, the Guest will pay a penalty charge of one days rent, unless the Guest has prior approval for a late check out. It is at the discretion of Casa Mia Beach House to grant a late check out.
11. CANCELLATIONS/RESERVATION TRANSFERS:
If you reservation must be cancelled for any reason, all money paid will be forfeited unless the beach house is rented for the entire cancelled period and for the full rental amount. If re-rented, monies will be refunded less the cancellation fee of $150 and accidental property damage insurance premium. If we are able to re-rent your week but at less than the original rental amount of your reservation, your refund will be prorated to reflect the difference of the lower rental rate. If you should have to transfer your reservation to another date after payment has been made, please notify us in writing at least 60 days prior to arrival. Transfer may only be made at the advertised rate of the original season or the new seasonal rate, whichever is the higher rate; otherwise the cancellation policy would prevail. Once a transfer has been made, a new Short Term Lease and Confirmation will be forwarded to you for your signature.
CANCELLATION BY CASA MIA BEACH HOUSE – reserves the right to cancel an agreement/reservation at any time prior to guest checking into property. In this event, rental guest will be refunded all monies paid and the owner will not be liable for any damages incurred as a result of the cancellation.
12.TRAVEL PROTECTION CANCELLATION/INTERRUPTION PLAN: Please consider Cancellation/Interruption Insurance to avoid some of the risks associated with the necessity of cancellation. These plans ARE OPTIONAL but highly recommended. CSA TRAVEL PROTECTION OR SQUARE MOUTH outlines the many benefits their plans offer on their websites or by calling them directly. www.csatravelprotection.com or SQUAREMOUTH.COM. Travel Insurance is non-refundable.

13. MANDATORY EVACUATION. If State or local authorities order a mandatory evacuation of an area that includes the Premises, Tenant shall comply with the order. Upon compliance, Tenant will be entitled to a refund through the CSA Travel Protection Cancellation/Interruption Plan of the prorated rent for each night that Tenant is unable to occupy the Premises because of the order. However, Tenant will not be entitled to a refund if, prior to taking possession of the Premises: (1) Tenant refused insurance offered that would have compensated Tenant for losses or damages resulting from the loss of use of the Premises due to a mandatory evacuation order. PLEASE SEE PARAGRAPH 12 ABOVE.
14. REBATES. There will be no rebates for inoperable appliances or faulty equipment, unfavorable weather, early departure, interruption of utilities, construction in the area or maintenance problems.
15.NO DAILY MAID SERVICE – While Linens, Bath, Spa and Beach Towels are included in the rental, Daily Maid Service is NOT, however it is available at an additional charge by calling (561) 441-5794.
16. 2nd Saturday $100 weekly cleaning fee includes change of sheets. Saturday cleaning: 10:45am -1pm.
17. TRESPASSING & POSSESSION: If Rental Guest (s) have not vacated the property on the departure date and time specified in the lease; it will be considered a criminal violation of trespassing. Prosecution, Charges and Possession will immediately commence.
FIRST FLOOR BEACH VILLA HAS EXCLUSIVE ENJOYMENT OF THE 41 JET THERAPY SPA, OUTSIDE HEATED SHOWER, TWO REAR PATIOS ADJOINING THE BEACH HOUSE FEATURING A PROFESSIONAL OUTDOOR GOURMET GRILL, UMBRELLA TABLE, CHAIRS AND LOUNGES. EXCLUSIVE ENJOYMENT OF THE FRONT COURTYARD PATIO WITH ENTRANCE BENCH, TABLE, THREE STOOLS.

When you leave WE ASK THAT YOU PLEASE:
*Close all windows.
*Please ensure groceries and containers etc. are removed from the refrigerator and cabinets and are dispose of in the outside front trash containers and proper recycling bins. PLEASE BRING BINS TO THE CURB FOR TRASH PICKUP SUNDAY & WEDNESDAY NIGHTS.
*Return kitchen items clean (dishes and cookware ) and returned to the proper place.
*Police the outside to make sure that you have picked up any trash or personal belongings.
*Make sure that you have not left any personal items in the villa.
*Check all closets, drawers and behind/under furniture for lost items. Please leave the property in a clean and orderly condition.
*Kindly ensure that air conditioning units are not left running at inappropriate temperatures.
LOST AND FOUND: We are not responsible for items left behind, however we do make every effort to locate and return them. Contact us and forgotten items will be sent UPS COD and a $15 handling fee will be included. Unclaimed items will be donated to local charities after 30 days.
LOCKOUTS: It is important for you to keep track of your villa keys. Lockouts incur a $65.00-$120.00 paid directly to locksmith.
OTHER TERMS AND CONDITIONS. In Witness Thereof: This Agreement is executed and being retained by each party hereto. This is a legally binding contract. If not understood, seek competent advice. This Agreement shall be governed by and interpreted in accordance with the law of the State of Florida. This Agreement shall be treated as though it was executed in the County of Broward, State of Florida, and was to have been performed in the County of Broward, State of Florida. Any action relating to this Agreement shall be instituted and prosecuted in courts in Florida. Customer/Tenant specifically consents to such jurisdiction and to extraterritorial service of process. Amendments to this Agreement must be in writing and signed by all parties. This Agreement represents the entire Agreement of the parties, and there are not misrepresentations, inducements or other provisions other than those contained in the agreement.
